Hello everyone, wondered if anyone can help Re: IB to ESA. ESA application form was sent in on 3rd January 2013. After 3 months still heard nothing at all. Is that normal or do I need to do anything?
One more question, if put into WRAG instead of Support Group I thought I heard there was a new rule that a person has to request a Review before appealing. Have I got that right? Thank you, as always, for your help. Rachias

Hi R,

As long as you are happy that ATOS received your ESA50 by the deadline given, the ball is in their court.

You could of course contact the DWP for an update if you wish, but your IB will continue to be paid until a decision is made on your ESA assessment.

With regards to your other query, mandatory reconsiderations have not yet come into force, and these will only really effect claimants who wish to appeal a fit for work decision, and not WRAG, as you would still receive the WRAG rate of ESA whilst undergoing any mandatory reconsideration.

Thanks for your reply. The application was sent by recorded delivery well within the time limit and no reminder letter was received from DWP so I am assuming they received it. Does 3 months sound unusual or are they very busy - there would have been a Christmas backlog. Benefits are still being paid as usual.

Hi R,

The time from ATOS receiving your ESA50 to you hearing something can vary tremendously.

We have heard from members where they have had a decision within a few weeks , and others where they have waited many months.
