I was on incapacity benefit for nearly ten years, it then changed to ESA. I had a medical and scored 15 points but was put in to the WRAG group which they said I went on to when it changed to ESA. I stopped receiving payments in december 2012 and am awaiting appeal. Reading the guides on here it says I should be receiving a minimum ESA payment while I appeal, why has this not happened? Apparently ESA only lasts 12 months then if you don't get put in to the support group it stops all payments. There was no mention of payments while I appealed. I am appealing against WRAG to be put in to the support group which my doctors letter supports. They wouldn't revise the decision at DWP and sent the doctors letter to the tribunal courts, having made their decision before receiving the letter.

Hi E,

As you were appealing an award of WRAG, then you should have been receiving the WRAG rate of ESA whilst appealing, see :

What will I be paid while I appeal? from our : Appeals FAQ’s

If you were being paid CB ESA in The WRAG, you would only be entitled to 365 days of payment before it ceased, see :

12 Month Limit for ESA(CB)

From our : ESA FAQ’s

If you are successfully placed into The SG by The Tribunal, then payment of CB ESA will be reinstated, and any differential of back payment owed will be payed from the date of the WRAG decision that you have appealed.
