ESA Reconsideration

Hi this is the first time i have posted so here goes my husband has got severe rheumatoid arthritis and a number of other health conditions he has been on incapacity benefit but has now been put on ESA contribution based ESA he has been put in the work related group.
We have phoned the dwp that has been dealing with his claim and i asked weather we could have the medical report that was used to make there disision and also the the form that the GP had filled in i was told there was no score sheet that atos had made there disision on the medical evidence but they would send me some information.
Well we have received the ESA85A form and on it it says
"The available evidence does not suggest that the client has severely restricted multi skeleton function.
Now maybe it is me but all the evidence that my husband has sent tells them that he has severe RA We have been looking to get letters of support from my Gp which when i spoke to her she told me that she had told them what my husband was like and would back me all the way.
We have been told to get letters from his consultant and GP to back this up but both are on holiday for another week and and we feel that time is ticking away so by the time we have these letters the month we have to ask for reconsideration will be up .My husbands RA is very bad he goes into hospital once a month for a infusion and all this stress is making him even more unwell.would be grateful for any advice or help thanks daupin

This is an all too common occurrence, this is the third case this afternoon of someone being placed into The WRAG on paper scrutiny alone.

We advise that you appeal in the first instance, as you will first receive an automatic reconsideration by a different more senior DWP DM any way.

Only if the decision was not changed at this stage would your appeal be automatically sent forward to The Appeals Tribunal Service.

You should not miss the one month deadline to appeal from the date of The ESA WRAG award notice letter.

You can simply write on the GL24 that you do not agree with the decision, and will provide further evidence once you have it.
