Does anyone know the answer to this. If you are on Esa Assessment rate whilst waiting for the tribunal hearing are you actually classed as receiving esa? Im just looking into working tax credits but its states you need to be on esa.

Yes, you are but you are not on main phase ESA which requires either the WRAG or Support Group component to also be in payment, so you will need to check with HMRC as to what is required.

Also ESA(IR) is not taken into account for Tax Credits, whereas ESA(CB) is, so it will also depend on the type of ESA you are receiving.
