No i was refering to ESA DM's going against an ESA assessor's recommendations of an award.
Taking away awards granted by a HCP in favour of the claimant.

Why i am somewhat paranoid of sending ESA 50 form direct to dwp local office addresses that deals with my benefits.
Or it could be a good thing and i get a paper board award!

Who knows! either way my local office are cutting to the chase ! at least making out they are by "indicating"

Hi c6,

You clearly mention "MR" in your last post ;

"i happen to think 3-4 out of 10 claims being turned down at MR is often,"

As you know an MR cannot take place until after a DM has first made an adverse decision.

As Gordon stated, an ESA Decision Maker cannot make a decision without an ESA85 or an ESA85A Medical Report first being compiled by "Medical Services" (Maximus).

ESA DM's have no medical qualifications, so if you had of sent the ESA50 to your "dwp local office" they would had to have forwarded it to Maximus.

Some Maximus Assessors are based as DWP JCP Offices, and some DWP JCP Offices are also venues for face to face assessments.

Anyway, we are now going around in circles ! :)

Omg! contacting the dwp today 1. 1/2 hours it took. sent round the houses, phone numbers have changed, incorrect phone numbers on ESA reminder letters from maximus !

My ESA 50 crossed in the post i was sent a replacement from local benefits center than the original from maximus arrived

ESA contact center point blank refused me a call back from my local benefits center office. I asked for an extension they point blanked refused that, saying there is no such thing!

i explained i needed a call back from local benefits center to inform them of good cause .. but nope no way even the contact center manager refused
saying it was in appropriate. but they would make a note on their system.

I have everything ready to send back apart from up to date medical records. GP surgery admin is going as fast as she can to get them ready.

i Thought they offered extensions ?

those contact centers have gone worse, what a incompetent nasty bunch of individuals they are , even the nice ones haven't a clue & act as though they've been lobotomized

The ESA legislation does not allow for any extension of the normal four weeks to complete an ESA50, unlike PIP which does.

It's not clear from your post when your form has to be returned by?

You can return the form late with an explanation of why, however, Maximus are known to return claimants files to the DWP only a couple of days after the required return date. Providing you can show that your ESA50 has been received it should be possible for your assessment to continue, but it will likely add several week to the process.

You can return your form on time, either incomplete or missing supporting information and then provide the additional information as soon as possible thereafter. If you do then I would recommend taking a copy of the missed information with you to any assessment that you have. Obviously you should keep a note of the address your ESA50 has been returned to.

Ah of course extensions only for PIP Oh well it made for a interesting screaming match with them
When the Maximus reminder letter arrived, CHAD on the phone told me the ESA 50 takes 7 days to be sent to them from the DWP? so they prefer the form to be sent back before the deadline
( even though the envelope is addressed to CHAD)

Said to the call handler even if that is the case
on the letter that comes with the ESA 50 there is a deadline that reads to be received by such and such date..
So i waited on extra evidence & sent form back one day before deadline tracked & singed but not to CHAD but used the local ESA benefit center envelope that had been sent with replacement esa50 form.

So i finally get a combined up-rating / award letter !!

Awarded support group ESA !!! paper board..

New award start date for this month, hope they don't try and swindle me out of these few extra months down the line.. and that this new award date now becomes the re-assessment start date..( or even later :) :cheer:
