If I had been given correct advice by CAB I would be coming out of the family home now with more than twice the money and DWP would be letting me stay on ESA payments whilst I proceeded getting a shared ownership home with this scheme i have been referring to. I do not believe CAB volunteers should be manning the phones and giving out advice when untrained. It basically has resulted in myself and my son never getting a permanent home. Rant over:)

Been there, done that!

It seems getting incorrect info is a common thing with CAB, and DWP, I am going to get the DWP to put in writing the fact that I am allowed to use my buy to let money for a home just in case although I cannot really see a way of doing it. Because I cannot claim anything once the 50 thous or so gets into my bank account, I would have to allow a reserve of quite a bit to live off whilst looking for and buying a home. The only home i could afford even without this reserve would be a run down tiny place in a really cheap area miles away. Then there is the fact I cannot travel or even view anywhere! Then there is the fact I will have to allow more money to pay my landlord 5 months rent upfront in Oct. I really needed ESA and HB to continue whilst looking for a home. My buying a home would save the government money in the long term. I am thinking about paying a specialist benefits solicitor to check that I cannot the ESA payments continuing for 26 weeks whilst looking for a home. The shared ownership people i have been dealing with who say they cannot help me unless i am in receipt of ESA payments seemed to think they had helped people in my situation where a DM had allowed the ESA payments to continue for a period whilst claimant found a home. Do you think just google specialist benefit solicitors, I found one before who would do a telephone consultation of an hour for £150 but how do I know this is a genuine solicitor? Is there a register or anything do you know?

You would be better of looking for a trained welfare advisor than a solicitor, benefit law is a specialist area and most solicitors have no experience. Have a look at the following

I know. My solicitor looked at my finances back then and told me I could not afford to stay in the family home, which matched what CAB said. Neither seemed to know about the mortgage interest support. But I have not been impressed with local welfare rights person that I spoke to over the phone, he told me incorrect stuff too. (told me that they take child maintenance into account when calculating ESA for instance). I am looking for a benefits specialist solicitor who knows all about benefits, there are not many out there

My case was with the DM yesterday when I rang benefit enquiries, the DM making a decision apparently whether to keep my case open. I don't know whether I should have asked benefit enquiries to put a note on the computer about the 42472 thing? If the DM closes it then I push about the 42472 thing, would it just be reopened. I don't want to have to start a new claim cos my original claim started before they took away the WRAG cmponent
