I would be surprised if they do not return your file to Maximus for an assessment to be done, but if they don't then raise the issue of paragraph 42472.

I rang benefit enquiries today cos i was hoping to find that the DM had returned my file to Maximus but it is still with the DM. The benefits enquiry guy said it is still there because I did not explain why it was late on the esa50 form. He said because I did not telephone through my reasons for it being late until the latter part of last week it will take 6 day from then for the DM to decide. I told him I phoned up sooner than that but the first benefits enquiries lady had said I could not give reasons for late esa50 over the phone. I explained that the second benefits enquiries lady I spoke to the latter part of the week had taken and noted my reasons for the form being late. (Sent special delivery on the due date, received with maximus 21st but returned). Then the guy said I am not allowed to give reasons for it being late over the phone. So now I am thinking is it really important that i should write a letter giving my reasons for it being late? (The DM I spoke to about my buy to let said my claim will be okay but she does not work on decisions re late esa50 forms)If I do a letter it will probably be too late now. Do you think I should see what happens? If they close it, and then I bring up the 42472 thing (will check that number!)will it be reopened and continue like the same claim that i started March? I want to keep on the pre WRAG component removal

I a previous post you said that you had explained what happened on the form when you posted it.

Have the DWP said you need to provide your reasons for the late form in writing, if they have then do so, but if they haven't then wait and see what happened.

One benefits enquiries person said they could not take reasons for the ESA50 being late over the phone but two other benefit enquiries people did take reasons over the phone. But the one who said it had to be on the form and would not take reasons over the phone said the DM would not look at the reasons taken over the phone. So I do not know ( I did not explain any reasons on the form as I recall I just amended the date posted from the 17th to the 18th and put I did not know if it would be late because I still think that return by should be able to mean send/put it in the post box by). My case/claim is still with the DM deciding whether to keep it open. I am still pondering putting my reasons for being late in writing but it will prob be too late by the time it gets there. However I sill have my further evidence relating to the ESA50 to send. This further evidence , additional ESA50 info, I do not know where to send due to my case/claim being with the DM . One person, said to send it to the address on the envelope that came with the ESA50 where I sent my ESA50, but another said send it to the DWP ESA25 address. It is difficult to know as my claim is a bit in limbo.

I was told today by CHDA that Maximus never do paper based assessments, is that right do you know?

You need to understand that the ESA call centre staff are poorly trained, a lot of the information they provide is actually incorrect, that's why you are getting multiple answer to the same question!

You can't do any harm by sending your reasons for the form being late, but don't send any more evidence to anybody until your claim is back to normal as this will confuse.
