1) I am 99.99% sure I am not eligible for CB ESA even under the special Carer's rule because I only had 26 weeks of National Insurance contributions in the tax year 13/14 (because I stopped being a carer in the September) Thus I do not satisfy the second condition. I should have claimed CB ESA back then, if only I knew then what I know now
2) I was tempted just to send it in anyway just in case but I am so worried that they may contact my landlord and I fear that if they did he may no longer want me as a tenant.

I do hope I am not being silly

It's entirely up to you!

Hi, just wanted to know if you know if a fit note that is backdated and also advanced dated as in saying indefinitely will work if I do ESA claim for National Insurance credits please.

Also for future reference when calculating capital for Income Related ESA, do they look at dependents savings, I put some money into my son's account a few years back

Hi Cruella,

The first 2 fitnotes for an ESA claim can be for no more than 3 months each. After that, it is entirely up to your GP.

As far as assets are concerned - DWP would look at you and any partner that lived with you but not dependents. Unless they thought you had moved money out of your own accounts simply in order to be under the limit and claim IR benefits. This will probably depend on how much money was involved and how long ago. If you have any doubts you should get face to face advice.

Do you think the GP will be able to reissue the fit note in to max 3 monthly ones? Am I right in saying that with ESA NI credits and any ESA claim the max backdating would be 3 months so I would need a ' past 3 months fitnote' for the backdating and then a max of ' 3 months from the date of the claim fitnote' for the future?

All you can do is ask. GPs can only issue a retrospective Fit Note if they are satisfied that they were aware of your issues at that time so it will depend on whether you saw then three months ago or not.

Hi , the problem is the GP issued a fit note backdated to June and put 'to' indefinitely. This is too big a period. Mrs Hurtyback explained this above. So I need the fit note to be issued into shorter period ones. She should be able to reissue shouldn't she?
