yes this is what we have but unfortunately dated 16/07/13 - All 28 pages are dated for this date

The only sheet relevant to the latest assessment is this random page they have enclosed which is page 6 and 7 of 7

You'll have to contact the DWP again. As to the MR request, I would recommend you send it within the month whether you have the correct report or not, you can include a note that you will be sending further information as soon as your receive the correct report.

The additional sheet (cover note)refers to a previous claim date and the current D.M (Decision maker)decision. So, you will see two dates. I.e your previous claim 2013 and your current reassessment date 2016 and the D.M view of your claim as of 2016.

As Gordon posted the current ESA 85 will have the name and qualification of the assessor and the date of the assessment..

What is the date on the front page of your ESA 85 report?

Even if the date is wrong you will need to apply straight away for the M.R otherwise you will miss the cut off time. I know it's hard. That's the whole point of the D.W.P process. Deny,delay,Dispute. Put your mandatory reconsideration in straight away then argue about your reasons later or face losing everything.

Hi Poppy - thanks for the reply

The report we received is dated 2013 - 28 pages

the separate double sided sheet only has a date at the back - 15/09/16, with a name and office.

I called DWP this morning and they said they will send out the ESA85 - he was a little coy on what had actually happened.

I will be doing the MR this weekend and submit via a local jobcentre next week

Hi Tayfun,

I've just checked my records and the 28 page report you have fits inline with my 2013 assessment. I.e the health care report in 2013 is 28 pages long.

My current health care ( lol) report (ESA85)is 33 pages long. If it helps the cover page states your name/date of birth etc. But, most importantly the DATE of the assessment /place and the duration/assessors name and qualification.

I suggest you write a quick letter for a Mandatory reconsideration.Use the guide on this website don't worry about going into details about your conditions as the Decision Maker will 99% agree with the health care professional.

If you can afford it post the letter via your local post office using their Special delivery 1st class service cost varies but, it's much safer than using the job centre. I.e the letter will be tracked and have to be signed for and from my experience arrives the next day!

The Decisions-claims,revisions,suppressions,etc paper starts with the following....... name,Nino,case number.
Followed by Part 3 Decision for Employment & Support Allowance. All tick boxes for your claim will have a x in the appropriate box.
Type
Claim
Decision dated ..... Revised..........revision refused.....superseded......not superseded...other

Then more tick boxes showing effect on benefit.
And finally the date from ie. 28.07.16
Followed by the details of the decision/descriptors scored.
At the bottom of the decisions-claims,revisions page.
There is a page number for example page 1 of 3. In my case I only received page 1/2 of 3 pages. Don't let this deliberate denial of information put you off requesting a M.R. As this is a delay tactic the DWP is using to make claimants miss deadlines I.m.o.

It's important that you don't miss the M.R. Deadline. So,get that request sent in straight away,don't worry about giving a reason or missing information.Use the basic letter in the members guide area as the DWP will just go with the HCP decision anyway!

Do not ever throw away any paperwork from the DWP and always ask for a written letter of any correspondence made via a telephone call.Personally,I only communicate via mail (written)with the DWP as they like to deny all evidence of communication via telephone/job centres etc.

Finally, Goodluck.... Get that M.R in now!

Just been told by mum that the latest assessment report has arrived today.. I will pick it up on my way home from work.

I've started the MR and already written 1 page going into detail of conditions and the inaccuracies of the statement of reasons for 0 points. My next stage is to go through each paragraph of the headings

Control of you bladder, bowels or stoma

Staying conscious when awake

But this is where I am having a brain freeze, do I write the limitations of my mums daily activities because of these (anecdotal) or do I need to use the exact wording as the scoring suggests?

I know at this stage writing purely that we are request a MR would be sufficient, but given the "evidence" they claim to have I doubt a reversal of the decision would be made therefore I really want to hit them with as much as possible, The original decision letteris dated 15th September so only have a few day left.

what would advise?

apologies for the long post.. but I am so stressed!
