It's official, got the letter today :)

But I'm afraid I also got a letter re my ESA today too!!! and would like again to ask for advice.

I was transferred from DLA to ESA approx. 2013, initially got nil points but after reconsideration placed in WRAG on reg 29. I did appeal but lost and have remained in WRAG since. Cont based ESA ran out in 2014 so I have not received any payments since then. I was due to be reviewed in 2015 but have not had any contact regarding this nor has my WRAG adviser been in touch for well over a year.


The letter I received today states that my ESA claim has been looked at following a recent change and then goes on to say we cannot pay you from 12/4/16 because you will have reached the max 365 days conts based allowance.

I rang to find out what the recent change was and after first being told there was nothing on the system re this letter was called back later and advised it was a computer issued letter and nothing to worry about.
I took this opportunity to ask about the much overdue review and was told it was because of the backlog and large number of claims. I asked if I could request a review but was told only if
my condition had got worse. It hasn't worsened but hasn't improved either.

My question is now that I'm receiving PIP and getting mobility on the grounds of being unable to walk more than 50 metres can I use this as a reason to try to get reviewed for the support group. I realise that using a wheelchair would also need to be considered but I would not be able to do this and can provide a good explanation of why it wouldn't be possible which ties in with my symptoms/illness.

This is difficult.

You say in your post in regard your condition "It hasn't worsened but hasn't improved either".

To request a reassessment there needs to have been a deterioration of your condition, this usually needs to be supported by medical evidence. If the DWP are not satisfied that there has been a deterioration then they do not have to review your claim.

On the other hand, the DWP are always keen to review a Change of Circumstances if they can (I know this contradicts the above) and as your ESA is not in payment, although you are receiving NI Credits that count towards a full State Pension, you have nothing to lose.

Be aware that this is would be a full reassessment of your claim, new ESA50 which you need to complete in detail and almost certainly a face to face.

If you want to do this then write to the DWP office managing your claim to notify them of the change. The letter is important as it would set the start date for any successful SG award.
