It usually takes the TS 7-10 days to acknowledge information sent in to an appeal.

I have now received a letter back saying that they have received my appeal letter and being dealt with sutton tribunal centre, they have asked the dwp for any written response to my appeal. at what point can I be back in touch with dwp and ask to be put back on the lower rate until my appeal date is given, many thanks

Give the letter a couple of days to get through the DWP internal mail system and then you should be able to request you be put back on to ESA.

Hi I am now waiting for my date for the tribunal and have been put on esa until then, they have sent back the copies of my doctors letter and it was signed by them by a doctor, I have now received a letter saying that my contribution based esa will run out 23rd of dec and after that they will credit me with National Insurance contributions while claiming esa, what does that mean? will I not get esa with waiting for my date for the tribunal, Thanks for any help

I assume you are receiving Contribution Based ESA, this is only payable for 365 days if you are not in the Support Group, when your ESA(CB) stops you may be able to receive Income Related ESA depending on your circumstances. ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)

If you think that you are eligible then you need to ask the DWP for an ESA3 to be sent to you so that you can detail your financial situation.

If you are not then and you are placed in the WRAG by your appeal then you will receive back payment of the WRAG component up to the 23rd but no payments following that.

If you are placed in the SG then you will receive back payments of the SG component and your ESA(CB) will be re-instated from the 23rd at the SG rate.

because of my husbands income i was unable to get universal credit when they stopped my esa, so will this mean that if my appeal isn,t before the 23rd of dec I will not be eligible for any esa
