I can't believe that after 3years and 3medicals my PIP has stopped I completed the new form asking if my condition had changed and was sent for another medical. This time the paramedic gave me no points for the daily living previous 2times 11points and 4 for mobility previously12 then dropp f to 8. I sent a mandatory reconsideration request using your guide going into detail. About my conditions , they refused to change decision. ME/CFS Fibromyalgia and arthritis also disc problems which surgery last year helped but still in pain. How can they take away my award when my conditions have not changed? I wil go to tribunal. Does the fact that I previously had an award help at tribunal when nothing's changed my gp has done another lettter confirming this. Thank you

I am guessing that the operation which you say "helped" is at the root of your problems.

Although a Tribunal will look at how you were the law requires them to look at how you are now, so you can include information from your previous award but you must deal with the PIP activities as you are now.

As you appear to have had the shorter AR1 form, it might be worth your approaching the appeal as if you were completing a PIP2 as a new claim and explaining your limitations in being to complete each of the PIP activities.

I think you r right. Even though my back surgery was secondary I was awarded PIP before my disc problem. It's my fibromyalgia and CFS that causes me the problems now the fatigue is horrendous , that's the reason o got PIP initially

Morning I was previously awarded PIP for both mobility and care twice scoring 11 and 12 points I was asked to complete AR1 called for medical and my award was 0 points for care and 4 for mobility.
I sent a letter explaining that my conditions have not changed along with medical evidence and a letter from my MP. Four weeks later my brown envelope arrived ,no change! My main conditions CFS and Fibromyalgia were not even mentioned , it was as though they don't exist, I also have disc problems which I had surgery for last year (this had no bearing on previous awards) and I still have problems at multiple levels and the consultant has written a letter saying further surgery would not be an option,, I have arthritis in my thoracic spine, hands , hips,and feet. The mandatory reasoning said no mental or cognitive problems nor were there any muskoscelital problems that would justify points. I don't think they even read my letter as it was quite clear in it that my main problem was high levels of fatigue and pain. It beggars belief that they can treat people in this way, I am in the support group for ESA due to the fibromyalgia and CFS, thank you for your excellent help in filling out the form. Sorry for the rant but I am so angry. I have asked for a call back, have you any experience of mandatory reconsiderations being reversed or will I have to now go through the tribunal. The system is a mess. Hoping that when the new Scottish social security system is up and running they will do as promised and treat disabled people individually and with dignity. ESA is not one of the devolved powers but PIP is hopefully the government will realise what they are doing to genuine ill people. Kind regards

Where do I start! In august I completed the new form think it's ar1. I was called for a medical it was a paramedic who did my assessment. A week later I received the dreaded brown envelope despite having received the benefit for three years I failed with zero points for care and four for mobility ,previously 11 and 12. I received his report which was an absolute joke, I appealed sending off my letter along with medical evidence which the paramedic refused at the assessment and a letter of support from my MP. When I called to check how iit was proceeding They said they hadn't received my letter or medical evidence despite the fact it was in the same envelope, I resent it,
Called them a week later this time they had my letter but still no medical evidence meantime I had received a reply, they were not overturing the decision. I am a member of your group so taking your advice I called the DWP explaining that the decision should not have been made as the medical evidence had gone missing, they agreed to look at it again, this time I sent it recorded delivery. My MP also emailed them because an email had been sent to him advising him that his letter would be taken into account when the claim was being looked at, he was not pleased as the decision had been made on the Monday prior to him receiving the email. I called them a week past Monday , at last they had all my correspondence. Meantime I had started the tribunal ball rolling prior to them agreeing to look again at my claim. I received a call last Friday my appeal had failed and they had received the tribunal papers. I decided to call them on Monday for an explanation. This time o was told that no decision had been made and my file was still with the case manager. I called my MP who was once again very angry, he asked for a case manager to call him back, she confirmed that my case was indeed with a case manager and that they were aware that I would be going to tribunal if the mandatory reconsideration failed. To date I am still waiting on the decision . Had any one else experienced a similar experience?
