Hi
I am filling out my sscs1 form to return for a tribunal. Can you tell me whether you should include any additional evidence with this form, or should you wait to be contacted or take it with you to the tribunal.?

You can but I wouldn't. Once your appeal is accepted the DWP will send you a copy of their submission and you can then prepare your own which should include any new evidence you want to submit. All of your papers must be with the Tribunal Service no later than 7 days before the hearing.

I hope you don't mind me asking another question. If I submitted the new evidence with the form, would the DWP get to see it before their submission ? If so is there any chance they could change their minds, and I wouldn't have to go through with the tribunal?

Hi Pamela,

We usually suggest that the claimant should delay their own submission until they have seen what DWP have to say. DWP will get a copy of this and they do, occasionally, change their decision before it comes to court - but it does not happen often.

My Pip journey started last June when I applied. I was awarded the lower rate living allowance with no mobility. I appealed through the mandatory review but the award stayed the same.
Just before Christmas I started the tribunal appeal but as yet have heard nothing.
In the meantime my condition is getting even worse, I know the tribunal doesn't look at this only the time when I applied. So do I forget the appeal and start all over again or go to the tribunal and hope I get the higher award that I feel I should have got in the first place.
To be honest I have found the whole process so draining both emotionally and physically.

You can't start all over again as you appear to have an award.

You can notify the DWP of a Change of Circumstances based on your condition deteriorating but be aware that this will result in a full review of your claim, a new PIP2 and almost certainly a face to face assessment.

Also, as this will result in a new Decision this could be the same award, a higher one, or no award at all, so you really need to look at whether you realistically can score extra points.

You do not need to cancel your appeal if you report a change, but any Tribunal Decision will be limited by the new DWP Decision, so as a worst case example; if the Tribunal make a higher award and the Decision from your change is Standard DL again, then it will be the latter that carries forward, although you will have a new right of appeal.
