NOTHING SURPRISES ME WITH DWP tactics

So my 28 days are nearly up for the DWP to respond to new evidence.
Solicitor and MP involved so did not expect the usual Bully Boy tactics some have reported on here and asked to withdraw my appeal.

WRONG !
This morning had a phone call from DWP about my PIPS claim saying they have looked at it again and would i accept low for moving around and high for mobility and withdraw my appeal.

NO I WOULD NOT !
Firstly they said i was entitled to NOTHING.
Then they changed it to low rate mobility only which is what i am getting.

Now there saying they will OFFER LOW & HIGH or if you won't accept it then to carry on with appeal.

OH THEY KNOW THEY WILL LOOSE, Its like dragging them kicking and screaming to the end game. ITS DISGUSTING ! :evil:

Be WARY of these TACTICS every case is different BUT BEWARE if there trying these tactics.

I have EVEN LESS TRUST which was rock bottom, did not think it could go lower, but this phone call takes the biscuit. I BET THEY WILL DENY MAKING IT TOO !

KEEP FIGHTING I AM DOING ! its taken months to get here, its the end game now and they would not be offering me this for no reason........................DISGRACEFUL how they are conning people out of benefits they are entitled to and clearly realise I know have enough proof. :lol:

For completeness, you do have the option of accepting the DWP's offer and then making a new appeal.

Gordon: I have no issue if you think this post hinders more than helps and, in turn, shouldn't be added to the thread. If in any case you would like the case law, let me know how I can send it to you.

Some years ago, a situation arose at a Tribunal where the offer of benefit pretty much entered the stage of negotiation. The case subsequently went before Social Security Commissioner Parker who made it clear that benefit entitlement was not dependent on what was akin to plea bargaining, In CSDLA/606/2003 at para 16:

"16. The tribunal pressurised the appellant into giving up her right to a hearing with respect to the care component. Equally bad from the public perception is that the tribunal awarded higher mobility, despite its doubts after it took the view that the appellant had been able to walk in and out of the hearing room more than once with little apparent difficulty. The conclusion is inescapable that the tribunal, in dereliction of its judicial duty, chose to strike a bargain with the appellant for the sake of its own convenience."

If this is what the DWP is trying to do, it is arguably unlawful.

Hi Gordon
Thanks for putting that on here it may help other people. HOWEVER I would like to get it resolved once and for all and do not wish to go through the lengthy process. They know they will loose or would not be offering it to me.

Had thought earlier on if they decide, i may accept and appeal against that, but its pushing the can further down the road. As you know caused me a lot of mental health problems
and don't want it to continue.

They offer of LOW for Looking after Yourself gives me the premium on my ESA thats why they don't want to award me the high for looking after myself, but I have evidence for that as well. There trying to get out the cheapest way. Now they know its not going to work.

It still would not surprise me if I get a brown envelope before appeal date because their figures of successful wins with PIP appeals is reflecting on how bad the PIPS system is and showing the PIPS system is not fit for purpose.

Will go the whole way now and get resolved properly, its taken since June from when I put in my DLA to PIPS transfer.

The DWP is breaking Law after Law, it makes NO DIFFERENCE whether its UNLAWFUL.

They are breaking the law every single day. Even been blamed for the death of hundreds of deaths attributed to suicides from disallowed claims that were perfectly entitled to the money they claimed.

Holding them account in a court of law is expensive and does not get the benefits resolved.

This is just the thin end of the wedge, if I contact my solicitor or MP, the DWP will just deny they ever made the phone call, this is how they are operating Unlawfully. But we cannot challenge them.

So its almost irrelevant, I have a whole case with flaws of when there acting unlawfully, thats how most cases that are refused are been dealt with in one way or another.

Its a SAD REFLECTION of how one group of people are been targeted.
