Sorry if I'm being a bit dense here - but what exactly does that mean? My understanding is that the Act still permits them to retain a copy of your full medical records (for whatever period) but are only supposed to look at the parts relevant to your case/claim. In other words we have to take it on trust that they will be sensitive and self-governing about this.

Do you also happen to know if claimants' medical records are held electronically, or in hard copy only? And for how long?


I'm afraid yes, you have to trust them!

They will hold it in the format they received it or created it, most will be a paper record.

Data will be retained for as long as it is required to be retained, the DWP routinely destroy information that is older than 14 months but that is a generalisation and I may be different for a specific piece of information. For example we know of claimants invited to claim PIP who have been unable to use DLA evidence from a couple of years ago because it have been destroyed and others who have been able to get copies from twenty years ago.

Jojo posted about four weeks ago that they were still waiting for a hearing date.

My appeal finally took place a couple of weeks ago - and it was successful. The judge awarded 30 points in total and I was also placed in the Support Group. This is more than I'd hoped for and, obviously, I'm very happy with the outcome.

There seemed to be no concern that I'd withdrawn concern for access to medical records - it was barely mentioned. All that anxiety for nothing.

My advisor says I'm due a pretty large sum of backdated payments for both ESA and the support group. As yet, I haven't received anything in the mail either confirming the tribunal decision and/or giving further information about when backdated payments will be paid. Does anyone know how long it usually takes to hear about these things?

Congratulations on the award.

It usually takes the DWP 5-8 weeks to process a Tribunal Decision, I would give them a call to make sure that they have received the Decision Notice.
