As soon as you have submitted the appeal and the Tribunal Service have accepted it, they will notify the DWP of your request. Once the DWP have received this you/your son can contact them and ask to be paid the ESA Assessment rate until his appeal is heard, he win need to maintain an active Fit Note throughout this period.

Thank you, I've nearly got it organised.One lot of papers I point out all the mistakes in the Reconsideration Notice,especially that sentence in the Reconsideration Notice about him having said he had back pain because he had lifted the wheelchair into his car twice, whereas it is not mentioned anywhere in the Medical Report form and one lot putting other points contradicting comments in the medical report form.

I wish I had found your site earlier but it's good to be able to write on here. I had a reply from the Courts & Tribunals to-day and phoned up the DWP who told me to go to the Job centre with that and I took a copy of the sick note which I had already sent (to the wrong address) anyhow the man at the JC was very helpful, showed me he had sent both to wherever they go to so son's Incapacity Payment should be put back while this is all going on. People who know my son can't believe he got no points for the ESA.Looking at the medical report for ESA and the other one for Mobility you would think they were for two different people.

Can you tell me what type of papers the DWP send in the 'bundle' that will be sent to me now I have begun this appeal for my son?

It will be all of the documents used in the making of the Decision plus a cover letter, so typically your claim form and all of the information you attached to it, the assessment report and any other evidence sourced by either the assessor or the DWP from you doctors, etc. and all of the documents used to manage the process.

What is the usual time it takes for the ESA Assessment Rate to be paid? I took the papers in on the 30th May to the JobCentre. They emailed a copy of the Tribunal letter and the Fit note but my son has received no payments to date. thank you
