This is still going on, no interim payment yet and posted the second three month Fit note today. Thing is while he was here my son got a message on his answer phone from someone at the DWP asking him to phone back before 18:30. He phoned me, as he does and I phoned the number. The woman who phoned was phoning on behalf of the woman who had written the lie (I mentioned earlier) in the Reconsideration Notice reply she had sent. The sentence she put was that my son had told the Assessor that he had back pain that day because he had lifted his wheelchair into and out of his car that day. Pure fiction of course as he didn't say it, I was there. He doesn't use a manual wheelchair and because of his kyphoscoliosis couldn't do it anyway. - I pointed that out in the info sent to the Tribunal. We still haven't had the bundle of papers yet but I know that can take forever.
*The point is, I am wondering what this woman is phoning for.* I've arranged for my son to be here so I can talk to her once she has done the identity check.
The woman I spoke to said it was about the appeal. Do you have any idea why she might be phoning?

They may be considering offering your son a more favourable Decision, but be aware that does not necessarily mean that they will offer the award you think that he deserves.

If they do then you have two options, accept the award or continue with the appeal. If you accept the award then you have a further right of appeal but you will have to start from scratch again.

If you continue to appeal then the offer will be withdrawn, we have seem members receive a second higher offer, but there is no way to know whether this will happen. The Tribunal panel are not bound by the DWP offer although they may take it as a starting point for the hearing.

Thank you, that's very helpful. I'll see what she says. If it isn't what he should have, I think I will refuse the offer and go to Tribunal because I believe he will win that.

Well the phone call has just ended and I have just been harassed for 55 minutes by the woman who wrote the Reconsideration notice. She said she was phoning to find out what I was appealing on. I said I thought they were supposed to send me a 'bundle' and she said that didn't happen I had to tell her what I disagreed with. She is saying because my son lives on his own and drives a car he is able to work. She can't get around the fact that she wrote that lie in the notice. I've only just stopped shaking. I tried to point out the wrong things the assessor had written, about saying he was able to walk up steps. Another thing about pointing out about him not being aware of everyday hazards and how I need to tell him not to let people into his flat without seeing ID, and that people he meets in shops may not be good people even though they are pleasant towards him she turned that to how he should then not be driving a car if he wasn't aware of hazards and that I should contact the DVLA.
She finished saying she would be sending the papers/bundle whatever to my son.

I'm sorry that you had this call, I thought that the DWP had stopped doing this as we haven't heard of this for some time.

Although there is nothing, at least that I am aware of, that prevents the DWP contacting the claimant at this stage, if you feel that the call was inappropriate or that the person was putting pressure on you to withdraw the appeal, or they were rude to you then you should consider making a complaint.
