Annen

Please make sure that the DWP know about your pension if you have not already done so. Pension income can affect ESA payments.

Thanks Gordon yes they know about it. My pension is below the limit for esac. I sent a statement into them. It's not a lot as I had only worked for them for 8 years and I was part time But they had to enhance it. I was very fortunate but it's not as much as my pay of course. I couldn't face taking them to tribunal even though my union thought they were in the wrong. But here I am faced with the same thing for this. Drs have always been very sympathetic and understanding I've found.and I've seen a few! [I've sent my stuff off today. Will let you know how I get on We had an interesting call with esa this am when they refused to confirm in writing we were sending in further info for the DM. My hubby told he of course she could as of course we know they can if they can be bothered. She wasn't having it. But we got her full name which she didn't want to give so we cd con firm the info.

Hi just to let u know that my MR was unsuccessful. I didn't meet any SG criteria and they said they upheld HPs view on the risks to my mental and physical health of work related activity. So to appeal. Looking for help on this if I I can get it from local advice centre. Their were many inaccuracies and downright lies in the HP report but of course it's proving it.

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

A tribunal panel will be less interested in issues in the report than hearing about why you think you meet the criteria for the SG, so this needs to be your primary focus of attention.
