It's not their place to stop the appeal, it's up to you to withdraw it if you wish to accept their offer, but you are under no obligation to do so.

I think that you can request a written appeal? That your husbands mental health would suffer drastically if he attended I think is good enough reason, as well written statement about how this process has affected him so far. (but I'm no expert, maybe Gordon could give some advice on this?)

I can certainly understand that he doesn't want to continue with the appeal, but as you say, that's what they are counting on. It's absolutely disgusting how they are treating people.

It is standard practice for the appeal to closed if the claimant accepts an improved award from the DWP, the claimant has the option of making a new appeal if they wish.

Thank you, Kris, for your response. We received the letter today outlining the new award and reasons why they feel it has now been awarded. I feel overall it paints a fairly accurate picture, although there are one or two points that I feel they have not considered fully. The letter also states that the original appeal will lapse and that we are entitled to lodge a further appeal against the new decision within 4 weeks.

At this stage, we are taking the 'offer' as it has been awarded until 2022 so at least for the next few years, we have a little certainty. We, of course, will use the next couple of weeks to consider all options, so have not entirely ruled out further appeal.

This whole system is so unfair and stressful that I feel so bad for people who do not have anyone to help them through. I know that if I had not found this site then I wouldn't have taken things as far as I have!
