Cheers Gordon - yes, I just spotted your comments on this very subject on another recent thread (TOPIC: Successful tribunal then ignored). It's very disheartening.

I understand the *argument the DWP is trying to use (*stunt they're trying to pull), but it seems clear to me from the decision letter I got. To my mind, this sentence can't be any more transparent in connecting the PIP decision with the DLA payment:

"Now we've made a decision about your Personal Independence Payment, your Disability Living Allowance entitlement will end..."

So now, I've gone from shock, through devastation and into fighting mode. I'm about to write to DWP, enclosing copies of their own correspondence, to let them know they owe me the backdated DLA - and I'm also going to list the other losses I've incurred as a direct result of their decision, such as the loss of car tax exemption and London congestion charge exemption and, of course, my blue badge (medical appt parking charges).

In other words, I'm going to bill them. Why not? I'd do it if it were any other kind of shoddy service. Has anyone explored taking the "consumer rights" approach and threatening them with the small claims court for non-payment and damages?

I'll also be pointing out the costs to the taxpayer of their shoddy work - the tribunals (I'll be appealing again shortly and also might take my original appeal to the Upper Trib, so that's at least three), and when I give them the total cost, maybe they'll decide it's just not worth it.

I hope to be such a pain that they need their own PIP just to deal with it on a daily basis.
