Hi All
Just received a letter from DWP today saying they now have all the information they need to decide if they can award me PIP.
I don't need to do anything they will write to me when they have made their decision.

Thought the goverment were all for saving the planet yet they waste paper and money sending me that when they could of just wrote and told me their decision straight away took them 3 and a half weeks for that response.

I got another letter on Friday this time from belfast telling me about the motability because DWP told them I either get high rate DLA or enhanced rate PIP.

Then I get another letter from belfast today telling me that I have been awarded PIP at standard rate for both daily living and mobility from 6 sept. I received 9 points for daily living and 10 points for mobility untill 2022
and another letter off of ESA telling me how much I will get up till the 5th of sept to which then I will probably get yet another letter telling me that on the 6th sept that will drop also.

So my next step now is to go through the mandatory reconsideration process as I'm not happy with the decision and the explanations she gave.
one of them being that Observations report you walked aided, slowly with a balanced gait 20 metres into the assessment room with no apparent breathlessness, fatigue or pain.
Firstly she walked in front of me so unless she had eyes in the back of her head she didn't observe anything, my gait wasn't balanced because I can't walk in a straight line or balanced I went into the wall at one point so guess she never noticed that also it wasn't 20 metres from the waiting room to the assessment room it was 14 metres at most. she also asked me in the assessment how far I could walk before I had to rest and I told her about a bus and a half which at most is 16 to 17 metres and she said not very far then.
Then we come to not being in pain how does she know if someone is in pain apart from having to take loads of pain killers to manage the pain not everyone can show their emotions or even want too, I've had about 12 years of this now I'm not the kind of person who can moan and grown at the slightest bit of pain I keep my emotions to myself and just keep going the best I can.
Another point that went against me was the fact I can drive a manual car, even though not very often as I do my shopping online I don't go out to pubs or anywhere where there are a lot of people I spend most my time in my home but that seemed to make no difference to her either, the fact that I can drive one was all she was interested in regardless.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Thanks Gordon
I phoned for my copy of the assessment report, very helpful lady on the other end put everything through on their computer and made the request for me also told me if I leave it to the end of the month to register my MR which can be done by phone call, then I get an extra 28 days to send in any extra info that I might want to add for the MR.

I'll get back as soon as the report comes through. Thanks again
