I now received the warning letter of the sanction. I received it on Friday the 20th and it asks me to tell them the reason why I did not attend, by the 25th.
Are they allowing enough time? Also I already told them the reason on the phone, so I don't see why I should repeat myself. I am thinking not to deal with them at all anymore since I told them the reason and all I got as a response was: 'I don't believe you are in this country!'. I have had enough of the intimidation. I am preparing a detailed complaint once and for all about how in one and a half year, even with my best intentions, attending every interview punctually (except the last one), I never got anywhere with these people. They have not helped me at all and only seemed intent to throw hurdles in my path and basically get me off the benefits. I need to do something about this. My aim is to take them to court. I think the first thing to do is to make another written complaint, the last one, have them respond to it, and then look for legal advice. I am prepared to pay a solicitor with part or even all of my ESA. I can't deal with these jokers this way anymore. As long as my housing benefit is not disrupted, I am willing to pay for legal advice. I want to take this to the next level, I don't have time or energy for their mind games anymore. Any advice of where or what to look for? I know no one is going to do the work for me, but maybe you can redirect me on some useful websites, for example....or anywhere I can get any help at all, even if it's information. I already bought a book where the ESA laws are explained but it seems very technical. Do you know of some practical books about, basically, what to do when you are having problems with the Jobcentre? Sorry about the vagueness....I myself am trying to clarify what I am looking for. Any advice is appreciated. Thanks.

First of all, be aware that a sanction remains in place until the requirement is satisfied.

If you don't respond to the request for information about why you did not attend then you are making it more difficult for your self in the longer term, both in terms of challenging the sanction and any complaint that you might make.

If the sanction is applied then your can request a Mandatory Reconsideration and of necessary an appeal.

Realistically, you need to have exhausted the DWP complaints procedure before you take any further action.

Thanks, Gordon. I will send a letter today advising that the reason why I did not attend is exactly the same one I gave on the phone.

I can't talk or phone to these people anymore, because if I do I will either shout abuse on the phone, or if I am there, I will get thrown out of the building. They can't wait for the last part to happen, it never happened even though these stupid people would call security as soon as I said I would not stop recording the interview. BTW, in the subsequent interviews, they stopped asking me to end recording, so they started to keep their mouth shut about it.

And this is for anybody else....you can record your jobcentre interview. They will say THEIR policy doesn't allow it, you just reply that their 'policy' means nothing since there is no law that says you cannot record. The smarter ones there will stop arguing with you, the ones who can't take the fact that you came prepared, will call security :) Just don't worry about their circus act, as long as you do not say or do anything illegal or abusive, they can't touch you, and if they do, they will be sorry later in court.

I am not saying you should be belligerent....that's stupid. Believe me, I am the last person who looks for conflict. But if THEY are belligerent, then you have the choice to buckle down to their harassment or fight for your rights.

PS. the rights I am talking about are the fact that they are providing a service, and that service should consist in -helping- you to get back to work in a hypothetical future. Learning skills, etc, I am all for it. I am learning stuff every day. I have seen none of this supposed 'help', all I have seen was provocation and intimidation. At the previous interview, they again asked me to stop recording and the manager got out and said, talking down at me: 'We are the Government. We will stop your benefits'. Notice how they say 'stop benefits' or 'stop your money'. They don't say 'sanction'. The translation is just: 'We want to throw you out on the streets, we don't care about you (or anybody else), we don't want you to get money 'for nothing' (they think everybody is like Mick Philpott, who had defrauded the system for years and had billiards in a nice house).

When I agreed to the WRAG activity, I agreed about my responsibilities, but I also expect them to fullfil theirs. I was expecting reasonable people, not loonies who try to boss you around and try to intimidate you, or try to find wrong things about you without knowing anything.

I am going to do something about this. Thanks Gordon, I will indeed exaust their complaint process first. I will do it by the book.

I wrote a lot of stuff before so I think I need to recap:

1. had to go to a WRAG interview. Tried to go, but turned back because I am waiting
to do a scan of the knee following an injury weeks ago. The hospital is delaying,
so I will have to start a complaint there, etc

2. phoned on the day of the WRAG interview and explained my problem. Tha 'advisor'
completely ignored all I said, and just blurted out in an angry tone: 'I don't believe you are
in the country'.
I felt highly provoked and proceeded to REALLY give her a piece of my mind; an inevitable
consequence of pent up anger due to all the rubbish I have been taking from these people on each single interview, always for different reasons.

3. received a letter asking to give a reason within 5 days. After what happened on the phone,
I refuse to speak to them again so I sent a letter giving the same reason I gave on the phone.

Now I received another of these stupid appointments. The letter reads: 'We want to help you, etc etc'. It's enraging how fake these people are, because their actions always reflect the opposite of that they write in their letter.

I will not go, been running around this farcical circle for over a year, I have to break it.
Even if I risk losing the money. I will try to get them all back in court, it has happened other times and I have always won. Maybe I will win, maybe I won't, but I am going to break this circle and try to make these people learn to stop giving rubbish to people and to do their job properly once and for all.

What I am trying to understand now is: if I get sanctioned, I need to receive a sanction letter with instructions on how to do a Mandatory Reconsideration, am I right? I have not received the letter yet, how long does it take normally? I know I have been sanctioned, no money in the bank.

PS. I have proof that they received the letter I sent regarding the reason for not attending.

Hope I was not too confusing, I tend to get lost in details. Thanks.

what I am trying to understand is , is the letter I have, 'keep your benefit payments' the sanction letter? there's written ESA FTA on the bottom. How do I request a Mandatory Reconsideration? I will only write and keep everything in writing. I can't phone these people.
