in the letter there's written:
''We will write to tell you how much your payment will reduce by.''

I didn't get any letters that tells me the above, (which is why I was expecting another letter)

''we will pay your full amount until we make a decision''

This part is not clear to me. Once they decided to sanction, the payments stopped, so what does the above means?

The letter does not sound like a Decision Letter, it needs to mention the Decision that has been made, why it was made and what the penalty is.

If a Decision to sanction you has been made then it could take 7-10 days for the letter to arrive.

There are sample MR letters in the Submission guide in the ESA area.

Decisions, including sanctions, require specific notification. If the letter you have received says what you have included in your post then it is not a Decision letter and you will have to wait for one to arrive.

Hi Gordon,

ok, something's wrong here. To sum it up:

I had a WRAG interview on 18th October which I did not attend. I phoned to explain that I didn't want to take risks with knee injury and that I have already gone to the doctor and agreed to have an MRI scan.

The 'adviser' completely ignored what I said, and instead blurted out: 'I don't believe you are in this country'. I was shocked. Then she just said 'we will stop your money'.

Predictably, I have not received the money. In the meantime, I was given another interview to attend two weeks later. This time, not only I didn't go, I didn't even bother to let them know anything, I am tired of wasting my time.

But, I still have NOT received the decision letter. I am thinking that they are doing it on purpose so that I lose my right to request a Mandatory Reconsideration. There's only one week left, so I am thinking to send a written request for Mandatory Reconsideration anyways.

Maybe they have stopped the money, but not through a formal sanction? They have always threatened sanctions but never followed up as I threatened back with court action.

Is it possible that they just 'stopped the money' without formally issuing a sanction? I think I should request for a Mandatory Reconsideration anyways, the worst that can happen is that I have wasted a stamp. What do you think? Thanks

here's another thing I am trying to understand. This is some info I found on the internet:

'' they can defer appointments if you are not well, but if you don't turn up without telling them, they will sanction your benefit. They can't take away your basic amount, but they can remove the top-up you received since you got put into WRAG. ''

can you confirm that this is true? I have not received a penny at all, they stopped the full payment. Thanks

Schopenhauer

A sanction is the result of a Decision being made and all Decision have to be notified in writing.

To be clear they cannot just apply a sanction that effects your payments.

If you want to overturn the sanction then requesting an MR is the next stage. The ESA Appeal guide explains the process and the Submissions guide has a template letter that you can use to make the request.

There is also a guide to Work Related Activity and sanctions in the ESA section that it might be worth looking at if you have not already done so.
