PIP Appeal Pending but paperwork exhausting!

Hi

I have finally had a date come through for my Hearing so I am trying to go through the paperwork but I find it so hard!!

Just reading what they put and knowing its not the truth gets me going and the fact I should not have to be doing this!

One comment is: There is no sign of malnutrition - in the Taking Nutrition Section and she goes on to comment about me having 'good grip, grasp and pinch' but negates the fact that I was wearing finger, thumb and wrist splints and was unable to do the pinch test and didn't have to do anything with the grip and grasp to prove anything!! How can she comment on 'no malnutrition' if she was unable to see anything and had not seen me before to compare this? I was not examined in anyway shape or form - do I mention this?

She also goes onto to report that because I drive occasionally (something else she completely misreports) she says this proves that I have good grip!!

There is so much information missing I may as well not bothered going!

There is so much its unreal - my head hurts - I was given zero points for most things even those its documented that I need help and assistance - how can this be?!

If they are our rights, why do we have to fight for them?

Your first priority is to show that you meet the criteria for an award, deal with the contents of the report as a secondary activity.

I know that you have been struggling with this appeal but you have left this late if you have a date for your hearing, your submission must be with the Tribunal Service no later than seven days before your hearing.

There is a sample submission in the Submissions document in the PIP area.

I know I have - but I just cannot get to grips with all of the papers, statements, what I have to fit, what I have to write, the criteria etc., I don't function at the best of times and this just makes me crumple, I hate it and makes me ill!!!

I am thinking of just packing it in to be honest or just not going - or if I do go, just winging it s I simply cannot cope with the paperwork!!! :-( :-(

If they are our rights, why do we have to fight for them?

You have the option of switching to a Paper hearing that you do not need to attend.

Whilst it's your decision on whether to continue with the appeal, given what you have gone through to get to this point, do you really want to give up without one last fight?

No not really - so how do i switch to paper so late - my hearing is the 5th Dec - and what is the success rate with paper hearings?

I am doing my best with putting something together but I really don't kow how I am going to function on the day either - this really should not be necessary :-(

You just need to contact the Tribunal Service.

Statistically Paper hearing are less successful, but can't really apply these to a single appeal.

If you are thinking of sending anything else in then it needs to be sent before you make the switch to a Paper hearing as you won't be notified when the hearing will be, just the panel's Decision.
