Can’t believe what I’ve just read! I feel angry on your behalf.
Absolutely astounded at the treatment by a RN. Terrible lack of care for you.

She shouldn’t be allowed to perform medical assessments ever again imho.

My Mandatory Reconsideration was rejected in part because I refused lower body examination/fitness testing.

Appeal date has since passed as I hoped and was promised an official reply from Maximus and some 2 weeks up to the appeal date closing I was told by Maximus their response was with their Solicitors. Dated 16 July, 2018, their correspondence has finally arrived and I submit for your perusal.

Currently, I have been removed from Support Group ESA and subsequently have seen a massive drop in benefits.

Now I have their letter I do intend to take this further and would be very grateful for some guidelines on the best approach. At the very least I think the original Assessment should be overturned and/or a new Assessment taking into consideration my ongoing Heart problems. It appears my local GP surgery did not have information from my Cardiology Consultant outlining prior diagnosis of Coronary Heart Disease therefore this was not submitted to Maximus when they approached my GP for a statement of facts.

Here is the letter from Maximus in full. It's sure taken long enough hasn't it!

I have made the letter confidential so that only you and the moderators can see it.

You are not too late to make an appeal, you can make a Late appeal providing you include reasons why the request is late and those reasons are accepted.

The key part of Maximus's response would appear to be their acceptance that the report does not meet their quality standards. It is worth your pursuing this with the DWP, this would be separate from any appeal, be aware that one probable outcome would be a new assessment, the report being withdraw does not mean that the DWP will necessarily accept that you meet the criteria for the Support Group.

Lodging an appeal now.... would that simply be as easy as speaking to DWP on the telephone or should I contact the Maximus Claire Bushby (Senior Customer Relations Manager) who drafted the reply?
