This latest version of the letter, it has been sent in a different format for years, is badly worded, possibly by intention.

The issuing of a Fit Note is a medical decision and in this context the DWP have no right to say it should not be provided to a patient.

Fit Notes are used as proof of incapacity during the assessment stage of ESA or Universal Credit. In this context the DWP will not accept further Fit Notes as proof of disability unless the Note details a deterioration of an existing condition or a new condition, reasonably likely to result in an award of ESA.

Fit Notes can also be used to enable payment of the ESA assessment when appealing a Fit for Work Decision.

So will my doctor still be ok to issue my sick note, I have to add I am awaiting a tribunal date, and I am not being paid anything, but I am still unfit for work

These letters are only issued when a claimant is found to be Fit for Work, you are past the stage where this would happen, so there is no reason why your GP would stop issuing Fit Notes.

What are you appealing? There are circumstances where you should be receiving payments during an appeal.

I asked you some time ago whether you are also eligible for Income Related ESA?
