TOPIC: DLA appeals process

Re:DLA appeals process 7 years 11 months ago #13528

Thanks for your response.

I’ll assume then that the statement on the Health Professionals sheet in the B&W Guide, the bit about disability in SS law being a long-term health problem that affects your everyday life, is a B&W view rather than a direct quote from DWP.

As far as I am aware there is no legislation within social security law that deals with specific disabilities, but under tax credit regulations there are definitions of disability which entitle claimants to Working Tax Credit in accordance with The Working Tax Credit (Entitlement and Maximum Rate) Regulations 2002, Schedule 1 which may be of some use to you?

There would appear that there is no reason why it cannot be cross-referred with social security benefits. A similar list existed with the now defunct Disability Working Allowance, which was a SS benefit previously administered by the DSS.

It is sourced from the Tax Credit Manual which can be read HERE .
