Hi lester,

With regard to limitations with walking, even though the Mobilising descriptor in ESA, includes the use of a manual wheelchair, unaided.

The criteria with DLA is still walking only, this may change if the new PIP replaces DLA.

You are doing the right thing in also mentioning your limitation with regards to the manual wheelchair.

2. Moving around.

a. Can move at least 200 metres unaided or with the use of a manual aid.

b. Can move at least 50 metres but not more than 200 metres either unaided or with the use of a manual aid.

c. Can move up to 50 metres unaided.

d. Can move up to 50 metres only with the use of a manual aid.

e. Can move up to 50 metres only with the use of a manual wheelchair propelled by the claimant.

f. Can move up to 50 metres only with the use of an assisted aid.

g. Cannot either–

(i) move around at all or

(ii) transfer from one seated position to an adjacent one unaided.

Mobilising with or without a walking stick, manual wheelchair or other aid if such aid can reasonably be used - Cannot mobilise more than 50 metres on level ground without repeatedly stopping or experiencing severe discomfort.

What this means in effect is that if you can propel a manual wheelchair more than 50 metres (even if you don't use one), you will not qualify for the SG and you will not amass the required 15 points for the WRAG to be found incapable of work.[/quote]

Hi lester,

I think I see what you are alluding to here.

In that, the fact that you have not been put into the support group, could be damaging to your award of DLA.

This is why you should request your ESA85a Medical Report, and the ESA65, Written Statement of Reasons.

You will then see under what criteria you have been put into the WRAG, which you can then challenge if errant.

Some ATOS ESA medical reports have been used by the DWP to review, and in some cases stop or reduce an existing award of DLA.

This is why you need to know what is in the report.

Being put into the WRAG in it's self should not have a direct affect on a DLA award, remember DLA is an "in work" allowance.

However, if anything contradictory to your award of DLA was written in your ATOS medical report (ESA85a), they could try and use this against you, re : DLA.

I hope this clarifies things more for you.

So in theory if someone has walking difficulties IE using crutches or a walking stick and could only manage say 50 metres then had to stop because of pain,but could propel himself over 200 metres in a wheelchair you could in theory score no points,is that correct.

This is the question I cannot get my head around, the only thing I claimed on was the moving around descriptor, I suffer severe pain on my right side and cannot walk or use my right hand, I have central post stroke pain syndrome,wheelchair self propeled out of the question, this was stressed on the forms, they must have scored me something to place me in wrag, why not the support group, anyway appeal off and request for esa85a and esa65, so i will fight them all the way.
