Thankyou Gordon, so I have read this right if I get ino the wrag group this would apply after one year after april 2012....

Claimants who lose the ESA(CB) will be eligible to Income Related ESA, subject to their meeting the associated Means Test of assets, income, and partners hours of work.

So I have a positive feeling that because of my income I would not qualify for income related ESA after the first year.

Does this mean then that I have no enttitlement to any benefit?.

I wouldnt qualify for jobseekers on income grounds.

So after being on incapatity benefit for 11 years, I lose all my entitlement, and will probably have to sell my home as I cant pay for the mortgage and move into local authority housing or private rental.

I distincly remember Ian Duncan Smith saying no present claimant would be worse off when he first introduced the system.

Have I read this situation correctly... anyone please and are their others in the same boat especially people with occupational pensions.

surely if Ive read this right isnt their a case for some kind of legal action???

Well thats it finished filling in the form. Took the test on friday and scored 90 points but in practice I bet I get no where near that, if anyrthing.

3 descriptors qualify me for Eceptional Circumstances which I feel is my best bet if i am to get into the support group.

So glad I found this site, I shudder to think how I would have been marked without the help here. Poor devils who dont no of this sites existence....'lambs to the slaughter'.

The more I go over this new new system the more I think its just a lottery based on, how good a reply the DWPs get from your GP and associated medical pros, plus is it a good day for the person marking you up, and have you got the right person.

Ill let you know how I go on when I get my brown envelope, but Im betting on a visit for a medical at best.

Well, yes and no. Claimants will be worse off after a year if they aren't eligible for income related benefits, however, the not worse off bit relates to the amount you are paid on transfer. If the amount of benefit you are receiving before you are migrated is more than you would ordinarily get afterwards, you keep your original amount.

Hi survivor.

Hardly a trade off though is it what you describe.

on the one hand i stand to lose ALL benefit and my home on the other i stand to gain a couple of quid.

It really is a lottery i have found after going deeper into this new system.

I thought Id seen the end of this kind of dirty practice by governments and departments where the most vunerable are at the mercy of a few at the top.
