care allowance appeal.

care allowance appeal. was created by john
i was awarded dla high rate mobility earlier this year but no care allowance, i then appealed this decision through an advice shop, they asked me to get further supporting evidence which i did, this morning i received a letter from dla telling me that my appeal had been refused, on looking through all the report that they sent me there was no mention of the further maedical evidence ! i then phoned the advice shop to ask them if they had sent it which they assured me they had, so i then phoned dla in blackpool and they say they have no record of it.they also state that one of the reasons that i do not qualify for carers allowance is that although my bedroom is upstairs but my toilet is downstairs and that they recognise that i am virtually unable to walk, the use of a urine bottle or comode would take out the need for my wife to assist me up and down the stairs which can take 20 mins at a time, i am now at my wits end and any advice would be greatly appreciated.

Hi John,

Carers allowance is only payable if the disabled person gets either:

A Constant Attendance Allowance paid with a War Disablement Pension (at full day rate) or Industrial Injuries Benefit ( at or above normal maximum rate) OR

Attendance Allowance or

Middle or High Rate Care Component of Disability Living Allowance.

So, until one of the above is awarded, it is impossible for carers allowance to be claimed.

As for your DLA Care claim, if you have copies of the extra medical evidence the DWP may accept it and again review it, or send your case to the Tribunal Service for a tribunal, if you asked for one. If so, I would ensure that at least the Tribunal service have copies of the extra information.

I think that the orignal poster is referring to the Care Element of DLA, rather than Carer's Allowance.

I mentally responded the same way as you did, however, upon a second reading of the post I think there is just a confusion of terms.

sorry pete, i have got mixed up, the appeal was for the care component of dla and not carers allowance, i thought they were the same thing !

Hi,

No they are separate benefits.

One can only claim Carers Allowance once one of the benefits I posted in the previous post has been awarded.

Did you ask for just a reconsideration of your DLA Care, or did you ask for an appeal with the reconsideration being carried out as part of the appeal process?. Or have you already been to an appeal tribunal?
