Hi All,

I just wanted to know if someone out there can throw some light on the question i asked the decision making dept.I will try and keep this brief.

I wanted to know why my husband was not put into the support group even though indepth infornation was provided by GP.

Not surprisingly i was told it was not the prognosis but how the ilness or disability affects ones ability to work.

So i pointed out that there was very detailed explonations filled out in each descriptor giving clear examples(i used the fantastic guide and sent pages of additional information)of the problems which are confirmed and in line with the prognosis

To my surprise the chap said can you supply further information??? I asked him if he had read the ESA50 form to which he replied he had looked through it, so i asked him what more can the GP possibly write?? as he had clearly stated that my husbands condition had not improved but deteriated giving clear reasons. :(

I was really surprised when he said that i should write more about how his illness affects him.(Dho, have you read the form???):lol: By the way he said he had made notes and would pass these on for reassessment :S

I am waiting for paperwork to come, but any ideas on what more one can possibly do???? :S

I would always recommend communicating with the DWP in writing rather than over the phone (I'm assuming that was the case) so you have a written record of the communication that can be presented to a tribunal if necessary.

As you have found out there is an additional reason - it can make your blood boil!

As a matter of interest, were you talking over the phone to the actual decision maker dealing with your claim?

And are you considering an appeal or have you already started the process and waiting for the appeal bundle?

Yes derek has a good point, write in and keep copies, the dwp will deny you have even spoken to them informing you they have no record of your call, get proof of posting with the letters, it is added stress which you can well do without. Wish you luck with it. How much info can you supply? You write loads what else can they be after? Does not make sense. It is quite scary when the decision maker says oh have looked through it. How about reading it? :dry:

Hi,

I did not speak to the actual decision maker, as this chap kept leaving me on hold to go and speak to someone else!!! but someone from the department, who by the way phoned me as no one else could tell me why a reason was not given as to why my husband was placed into WRAG.

During the conversation he kept asking why i think my husband should be in the support group and i gave many valid reasons and questioned if he had the file in front of him, which he confirmed he did.

To cut a long story short he said eveything i had told him he had made a note of(i wonder??), and would pass on to the reassessment team.

I still requested a ESA65 as he told me that as my husband did not have a medical there was no ESA85A, is this correct????

Furthermore, i clearly stated that i will be getting more supporting info from my GP as my husband has been discharged from most Consultants and present Neurologist has not seen him for a year(appt Jan 2012),
so reassessment DM should wait.

I am now wondering that as all this happened last Thursday, should i put all this in writting to DM Reassesser???

Still not recieved ESA65!!! :S

as your husband was put into WRAG and did not have a medical there will not be an ESA65 [this is what I was told when I requested] but there should be an ESA85a as this is what the ATOS hcp fills in when there has not been an actual medical, having... supposedly... read the esa50 etc. :blink:
strangely I contacted my MP who asked a case worker to look into it and she spoke to someone who then phoned my husband and she told him that there wasn't a ESA85a but they'd send the ESA65?????
:ohmy: :S needless to say I got the ESA85A and a reassesment sheet from the DM...

hello, (Moderator, i dont know if you want to post this or just put a link to my thread; ESA Appeal- Confused again! ? it basically says the same thing other than the update about today. i will be updating that thread anyway later)

exactly the same thing happened to me, the woman kept leaving me on the phone to go speak to someone else that i could hear quite clearly tell them to tell me i need a letter from my gp stating what descriptors i matched for the support group. she then told me that there was no ESA65 as i did not have a medical, only the ESA85a (you it seems were told the reverse) she then said i hadnt been point scored at all (not that i hadnt scored any points)

i wrote a complaint letter detailing all of this clearly & asked for the decision makers statement of reasons & exactly how did i qualify for WRAG when there was only 3 ways to qualify. 1) your exzempt 2) you score 15 points or more or 3) you satisfy 1 of the exceptional circumstances rules. so did the exceptional circumstances rule apply to me? & which one? & why was my ESA50 that took me weeks to fill out & provide all the supporting evidence not point scored? was it not even read then?

i recieved a letter stating they had recieved my letter, but the rest of it applied if i had appealed, not the complaint. (i had previously recieved a letter stating my appeal was going to tribunal, so why was i getting another one saying "we recieved your letter & a DM is going to reconsider & if no change then it will go to tribunal") A total confusing mix-up!

i have spoken to 3 people today re this, have sat in all morning waiting on call backs & am still waiting on a call back promised for 3pm to finally sort the mess out once & for all hopefully.
