Sorry Martin,

Can i ask when you got the decision of WRAG, were you told that your paperwork would go for reassessment or did you wait for statements of reasons etc as i am really confused about this 4 week deadline and when does it kick in???

By the way has anyone contacted you with regards to WFI's as i explained to the chap my husband will not be able to cope with these and gave reasons only to be told to sort it out with the Job Centre Plus when they contact him

Thanks Radhika.

Hi R,

The ESA85A, is the medical report compiled by the ATOS HCP, when a face to face does not take place.

It is classed as a restricted medical assessment.

Within the ESA85A should be reasons why your hubby has been placed in WRAG, with respect to his medical condition, and the qualifying descriptors.

It should also make reference to what medical evidence was used to come to the recommendations, ESA50, ESA113, etc.

It will also have his prognosis, this would be the expected date for his re-assessment.

The prognosis may be 3, 6, 9, 12, 18, or 24 months, or "in the longer term".

There is some debate at the moment as to whether an ESA65 (Written statement of reasons) is also written, and an FOI request has been made.

On the feedback that we have gained thus far it would seem that the ESA65, is not generated when a claimant is put in WRAG without a medical.

It may be prudent to request the ESA85A, and all other documentation used to assess your husband.

Hope this helps.

I DID have a medical and I received and ESA85 and an ESA85A (with the same wording but different prognosis!). I was also told I couldn't have an ESA65 because I didn't have a medical!

Hi,

Can you tell me when this 4week deadline kicks in as i spoke to them last week thursday, date on leter is 15th October, and was told it would go for reassessment to reconsideration officer.

I have asked for decision makers reasons and have stated that i will supply further evidence from GP etc.

So do i wait for paperwpork to argue his case incase of discrepencies etc or do i just get further reports from GP who by the way is really supportive and wrote a detailed report to submit with the ESA50.

Not sure what to do and really do not want to deal with DWP unless i have to.

Thanks Radhika.
