I would add that I'm in the Civil Service but do not work with DWP. In my job I'm also a decision maker - or some times refer my decision to be agreed by a senior officer. I will not even attempt to start a 'case' with out all original or certified copy deeds in front of me.

It would seem that you are already progressing this matter as aggessively as you can. I am impressed that you have actually managed to make contact with the Decision Maker dealing with your sons case, no mean feat in itself.

However, I can only repeat my earlier comment, that it is not standard practice either by ATOS or the DWP to seperate evidence from the ESA50.

That said, whilst the DM is obliged to review all evidence, they are entitled to choose what content they believe is relevant to making their Decision.

Thanks Gordon, the DM told me that he could call for the submitted evidence but this was sent to an off site storage facility after review by ATOS and it was time consuming and awkward for him to access hence his request for me to fax the letters. My son's main problems are Joint Hypermobility, Kidney disease, Aspergers and now potential problems with his frontal lobes that are linked to violent thoughts and feelings and visual disturbances.

Documents are certainly sent to an offsite storage facility after an assessment is completed, although I would have thought they would be retained lcoally until at least one month has passed after the Decision notice has been issued, to avoid unnecessary expense in having to re-call them if an appeal or Reconsideration is requested.

I can only speculate as to what has happened in your sons case. :dry:

Gordon,

As a Civil Servant I suspect that the Senior Managers have placed the DM's in a position that places them under pressure to get the decisions made as quickly as possible and not to get too caught up in going into details. I know I've been in that position and been in trouble for insisting on thorough research.
