I hope its okay to ask this, the little that is left of my brain is struggling to understand/believe what Lord Freud said in the Lords yesterday. But it seemed he was saying if you went into ESA Wrag ontributions rate the 'clock' starts ticking as soon as you apply and if you get to the 365 days your ESA will stop and you will not be able to claim again as you would no longer be eligable... even for the Support Group :ohmy:
So if you got hit by a bus and completely paralised you would get no help from the state at all because you had used up your 365 days Contribution based ESA entitlement.
I've mis understood haven't I? Please :unsure:

There were a number of good points made by the Lords and Ladies of the Upper House, who were tabling amendments to the Welfare Reform Bill amd in particular Clause 51 which deals with the time limiting of ESA(CB).

Most of these were not answered satisfactorily by Lord Freud, in many cases he either avoided answering or answered a different question entirely.

However, with regard to your quesion, yes, he did state that there are circumstances where a claimant who has already spent 365 days in the WRAG, who was not eligible for ESA(IR) due to the means test, would still be unable to claim ESA(CB), even if they now qualified for the Support Group.

thank you Gordon 'sigh' I was really hoping I'd got it wrong.
Makes me wonder if it would be legal... but then they change the rules/laws to suit themselves it seems.
Gosh you'd think it would be splashed all over the papers and tv :(

So what will all those who like me fail the means test due our savings do after all our money is used up ?

So is what they are saying once you are off means tested ESA you will never get back on regardless of your situation either health wise or financially ??

It only relates to ESA(CB). If you were single and had no money you would still qualify for ESA(IR)

ps you would still be in the Support Group, you just wouldn't get any money, as far as I am aware.
