Sorry but I don't think we are.

You're saying they'll be in the SG without payment.

I'm saying that they won't be in the SG and they won't be receiving payment.

So someone who meets the SG criteria now can stay there indefnately, but someone in WRAG(C)for 1 year can never qualify for SG at a later stage, even if their condition deteriorates or they aquire a new condition?

So if I am put in the WRAG group and appeal, if the appeal is not resolved before April, it won't really matter if I am successful because I won't be paid anyway! crazy.

My understanding is that the Support Group overrides contribution based 12 months ESA. If you qaulify for the SG there is no 12 mon th limit, and even if you are a millionnare, you'd still be paid

That is the reason why the Support Group will be the much wanted allocation for migratees and new claims.

You'll have to excuse me if I display slight frustration, members are making generic statements regarding something that we have already stated is quite specific :(

The Welfare Reform Bill limits the receipt of ESA(CB) based on their time in the WRAG, anyone who has spent a total of 365 days in the WRAG, will no longer be eligible for ESA(CB).

Claimants can claim/transfer to ESA(IR) if they meet the means test, if they don't they will lose all entitlement to ESA, with the exception of NI Credits.

Claimants can requalify for ESA(CB) if they can accumulate sufficient qualifying NI credits, or, qualify for ESA(IR) if they can, through a reasonable change of circumstances, relieve the constraint that is preventing them satisfying the means test.
