New Regulations on Appeals to First-tier Tribunals given as Decision Makers Memo :
Memo DMG 20/13: Mandatory Reconsideration Prior to Appeal and Direct Lodgement of Appeals with HMCTS
This memo gives guidance on regulations(1) which enable the Secretary of State to require a person to apply for a decision to be revised (i.e. mandatory reconsideration) before they are permitted to appeal to the FtT. The change comes into effect for decisions notified on or after 28.10.13(2) where the notice of the decision includes a statement to that effect. PIP and UC decisions have been subject to mandatory reconsideration prior to appeal since 8.04.13 and 29.04.13 respectively. Guidance on mandatory reconsideration for these benefits and new style ESA and JSA can be found in ADM Chapter A3.
