esa reassessment was created by Ruby
Hi
Please could you give me some information about my esa reassessment.
At the moment I am on contribution based esa in the support group.
I first applied for esa when I was diagnosed with cancer in 2011 and was placed in wrag without a f2f medical. I immediately appealed to the DWP explaining I was having chemotherapy and was moved to the support group.
I completed another ESA50 in 2012 and remained in support group without f2f medical. The same in 2013. Now I have received an ESA50 to complete and would like to know:

1. Can I be moved to wrag without a f2f medical?

2. If I was moved to wrag would I be eligible for contribution based esa?

Thanks in anticipation

Hi Ruby and Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

To answer your questions -

1) Yes, it is possible to be moved from SG to WRAG without a face2face assessment. It happened to me recently!

2) Yes, you will remain on contributory ESA if you are moved to WRAG. However, each claimant is only entitled to 365 days payment of contributory ESA when not in the SG. After this payment will stop unless you also qualify for income-related ESA.

I suggest that you make full use of our ESA guide when filling out the ESA50. If you wish, you can use the PDF version of the form.

Hi
Thank you for your prompt reply.

I have bookmarked this page as suggested and will use the ESA resources to complete the ESA 50.

Can I just clarify:

1. Is there any maximum time spent in he support group since being employed that would prevent me being entitled to contributory ESA in wrag?

2. Do you need fit notes from the GP in wrag?

3. I havent got time to get a report from my consultant before the deadline to return ESA50. Have you any idea if Maximus will contact him even though he charges £70?

Really appreciate any advice and thank yiu once again

There is no time limit for the payment of ES(CB) for members of the Support Group.

If you are moved to the WRAG, then the period of any continued ESA(CB) payments will depend on any time you may have spent on ESA when you were not in the SG. From your previous posts your initial claim placed you in the SG (after an appeal), so you have spent no time outside of the SG and should be entitled to the full 365 days of ESA(CB) payments in the WRAG.

You will not need to provide Fit Notes if placed in the WRAG.

Our experience is that Maximus rarely contact a claimants medical references, so our recommendation is that the claimant source, if possible, their own medical references.

Well after waiting for months i finally received an appointment for a medical.

The wait has been torture and now i feel completely overwhelmed and scared.
My sister rang to rearrange the appointment as i am at hospital that day.

However i just cant even cope with the thought of it. Also i was very thorough with the form and sent loads of medical evidence explaining my limitations. I therefore expect to be found fit fir work.

I have spoken to my family and have the option to move in with them rent free and rent my house out for an income.

My question is:
If I dont attend the rearranged medical i understand that dwp will stop my esa but can they request any esa money paid prior to this? For example from when maximus called me for medical?

Also are there any other consequences of not attending medical?

Thank you

Please think this over. Just because you have been invited to an assessment it does not mean that you will be found Fit for Work, you could remain in the Support Group.

If you do not attend then you claim will almost certainly be closed (you won't have to pay anything back).

Having your claim closed will mean that you likely lose your right to claim Contribution Based ESA on any future claim and the income from renting out your house could preclude you from receiving Income Related ESA.

However, anxious you may feel about the appointment it seems to me that your options should you not attend are all far worse.
