Hi there sorry to jump on your forum.

I did the telephone call to start the ball rolling for my husband's PIP claim from DLA- I gave them all the details they needed and they said they would sent the form out. We got a brown envelope today saying that I have to become my husband's appointee before they do anything else. As far as I knew I already was. Will this delay my husband claim??

Hi JC,

It will be up to you to initiate the claim. You will have 1 month from the 'invitation' letter otherwise you risk for DLA claim being closed arbitrarily.

DWP would like everyone to do this over the phone. There is the option of requesting the PIP1 form to be sent to you - but DWP are trying to pretend that option does not exist and we have some members who have had terrible trouble trying to get the form sent to them. So, although it grieves me to pander to DWP, it is much easier to get the claim started if you can phone them!

It looks like B x has had all their questions answered but it really isn't fair to them to have other members asking unrelated questions in their topic.

Either you have been made an appointee by the DWP before or not, you cannot be an appointee unless the DWP have agreed to it as you are assuming legal responsibility for your husband's benefit affairs, so I'm afraid, acting on his behalf does not make you his appointee.

They will need to interview you and your husband so it will delay the process by at least a couple of weeks or however long it takes for them to arrange to see you.

Thank you for your reply Mrs Hurtyback

I have Brain Damage with cognitive impairment and social phobia memory problems etc

Filling in a form over the phone i feel would put me at a substantial disadvantage as i fear i would not be able to process information or answer the call correctly

Also the Lima software without a face to face to place me in the Support Group For ESA (esa85 a) came up with

13. Coping with social engagement due to cognitive impairment or mental disorder.
Engagement in social contact is always precluded due to difficulty relating to others or significant distress experienced by the individual

This is a DLA to PIP transfer which has not yet happened,i will not be initialising this process the DWP when they decided will.

Just make sure that you manage the process carefully, the timescales are short and it would be easy for the process to get away from you.

What I meant by you initiating the process is that, although DWP will write and 'invite' you to claim PIP, nothing else will happen until you have either completed the PIP1 by phone or submitted a paper PIP1. There is a limited time for you to do this otherwise your DLA claim would be closed.
