Hi - My wife had DLA indefinite for higher rate mobility. After the PIP assessment she only scored 4 pts on mobility so no award but was given the standard care award. She is over 65. ( She only missed staying on DLA by a couple of months). When she is reassessed in 2/3 years time if her mobility condition has deteriorated will she be assessed on mobility and care or just the care?

I'm afraid she cannot receive a mobility award on reassessment as she is over 65, the only way around this is for her to challenge the current Decision. What did she score the 4 points for?

They said she could walk between 50 and 200 meters despite noting that she walked slowly with a slight limping gait. It also states that she has a weakness in her lower limb but they decided on the 50-200 meters. She asked for an MR about 6 weeks ago but she has not had a decision yet. So if she gets enough for standard rate mobility am I correct in thinking that she will be reassessed for it in 2/3 years?

I expect it will be for the same period as the Daily Living Award, but the DWP are reassessing claimants a year early.

There are enough differences in the DLA and PIP criteria that a DLA HRM award would not necessarily result in a PIP Standard Mobility Award, but we would expect most to be considered as unable to walk more than 50m.

Two things to look at; the PIP Claim guide for "reliably" and the "majority of days" and there is a DLA guide for defending an HRM award that might help with thing such as speed and gait.

Thanks again Gordon I will look at them if the MR is unsuccessful and we have to go to appeal. Is the DLA guide on the website? There are a couple of errors that they have made on the report that I will state at appeal - mixing up left and right limbs and missing a condition off the history even though it was listed on the form my wife filled in.

Hi gordon So if you have been awarded HRM and HRC for 10 years PIP im coming up for 65 now would i be ressessed for PIP after 10 years because i was of working age when they brought it in or would i have to go on AA?
