Hello I'm really struggling with DLA to PIP claim: repeated terrifying panic attacks, I'm not thinking clearly at all under such pressure & inhumane treatment. I have severe mental health probs & struggle to function even at the best of times.

My question is regarding side effects of medication: I take a high dose of sedating tricyclic anti-depressant at 8pm which usually knocks me out until 10am the next morning, if it doesn't I take sleeping tablets which mean I can't do anything at all the next day. I am currently taking diazepam during the day as well because I am so anxious/unstable/suicidal (sorry).
Am I 'over-reporting' if I say I can't walk 3m to the bathroom between 8pm-10am without hanging onto the walls because the medication affects my balance & coordination? I wouldn't be able to walk out of the flat & down 2 steps without help from someone if there was a fire between 8pm-10am.
I previously got higher rate DLA for overnight care.
I am so scared they will say I'm lying.

If you are affected in this way then you are not lying however I'm not sure that it would qualify you for a PIP Mobility award :(

I'm afraid the HRC award will not be relevant as it only considers your care needs, not mobility and PIP takes a lot less interest in the time of day that a claimant is affected than DLA does.

You don't indicate what your walking distance would be between 10am and 8pm?

I think it likely that the assessor and DWP Decision Maker will take the view that most of the time that you are extremely limited you are in fact asleep, there is also the issue that the Moving Around test looks at your ability to walk outside, although you should be able to show that you would not be able to go outside in this state

If you are restricted during the day in your walking then I would lead with this in preference to overnight, if not then you can certainly make the argument that for the majority of the time (14 hours each day) and as a consequence the majority of days, you are limited to less than 20m, but you will need to go into details about your problems and may need medical evidence to confirm that you are affected to this extent.
