Hi

I sent my SAR form to the local jobcentre last week and today I received a telephone call from a member of the data protection team asking for proof of my address as the one on the records did not match the address on SAR form. I explain I could not send any proof other than the address on the form as I have never moved and when I asked is the address on your records........................the response was a sharp intake of breath, so I am sending a copy of my council tax bill, after being told it was against the data protection act to send information to the wrong address! I think this is going to be a long process!

That's an interesting Catch 22 that I had not considered, hopefully the CT bill will allow the information to be provided.

I have received all the paper work requested under SAR and can find no evidence of a change of address, and then I received from the DLA dept that my claim for DLA would be rebuilt and paid and that I would be sent an invitation to apply for PIP - quote ' for some reason the NIRS recording system amended your address. Please be assured this has now been rectified'.
What is the NIRS? This letter was sent about 3 weeks ago however ESA dept still wished to proceed with the tribunal and I would recieve the papers around the 27th however today I have recieved a text from ESA dept qoute' we've looked at your claim again and agree with the information you sent to us. An ESA arrears payment of.......will be paid to your account ' Can I complain to the Information Commission and my MP ? as I do not want anyone else to through this horrible experience! Thanks so much BW and Gordon.

NIRS is the National Insurance Recording System which seems to be administered by HMRC.

Yes you can complain;

Contacting your MP

You do need to find out who the Data Owner is, this is the organisation who maintains the information, if it is due to NIRS then this would suggest that it is HMRC rather than the DWP that you need to make the complaint about.

You can also complain to the DWP, it may be worth your doing this before you complain to the ICO.

You'll need to phone HMRC to check that the DWP have actually informed and rectified the NI(payment/credit)error.

Hello
I have a received a reply to my complaint from the DWP about the incorrect address it appears that a benefit processor or system update wrongly selected the incorrect address for me and then proceed to send that address to the medical services but they claim the that they noticed the error on the same day and changed it back to the correct address but did not realise that the medical services had picked up the wrong address and went on further to claim that all my correspondence from the DWP continued to be sent correctly to my home address ! Why did DWP stop my DLA in March 2016 and did not send any correspondence to invite me to apply for PIP? and I did not receive any correspondence since 2015 from the DWP. If the DWP corrected the address mistake on the same day!
The complaint resolution manager did apologise and she is going to ask for a special payment officer to consider a small consolatory payment in recognition of the error! Can I take my complaint further or write to my MP or complain to ISO?
