Hi! Just read the asset rule in the FAQ's. I understand it... mostly. My sister is severely disabled with MS. She is in the Support group. Our Dad died recently and left us a modest inheritance. This takes her over the £16,000 limit. She also gets income support. Her letter from JC+ says she is entitled to 'both contribution based and income related ESA'. This confuses us in relation to the asset rule. Could you tell me please - a. Does this mean she has to declare the money to ESA or not. b. Does this money affect her IS. Thank you so much. Regards. Are you sure that she is getting Income Support? ESA and IS are overlapping benefits and only the ESA should be in payment.

However, the rules for IS and ESA(IR) are the same with regard to assets, so yes, she needs to declare the money to the DWP and if she is over the £16,000 limit as a result of this inheritance then any IS or ESA(IR) will stop.
