We stated these on the form but yet the decision has no mention and scored 0 points saying because you have sufficient memory and understanding to be able to drive a car and so would be expected to be able to manage your medication effectively. But we also stated that he was only able to drive provided he hadn't taken his higher doses of medication . Could you please advise thanku

It should be counted as an aid but would only score one point for Descriptor (b), but you need to explain why you need the dosette box and alarms and what would happen if you did not have these.

I think that you can successfully argue that memory, at least in the general sense, is not a prerequisite for driving and certainly that the issue of remembering to take medication at a particular time is very different.

Thanks for the reply. I thought he should of been given the point. He has been awarded enhanced rate for mobility which is great news as he will get to keep his car. He used to get low rate care on DLA but has been awarde standard rate care which is great news too, however he scored 11 points and had he been given the extra point for the aids he uses for medication it would of took him to enhanced rate care too. After discussing his options with him he is very happy with his award and decided to not ask forr it to be looked at again as the award he has been given is more than originally had on DLA and is too much to risk losing. I think he may of been awarded it for longer as he was given it for 2 years as his condition will never get better only worsen. But I am going to request the copy's of everything used in the decision and hang on to them for future reference as before we know it we will be filling those forms in again. He is now due a review on his esa where he is in the wrag group. Due to his care being increased he is now going to receive help from a carer which will be a great help. So I'm hoping he will be put in the support group of esa as surely someone who has a carer can't be expected to be in the work related group. However I wish to thanku all from the bottom of our hearts for the help we have received from this site and I will deffo be making good use of your guides to ESA reviews next once again thanku so much x

Hi Tl,

Thanks for the update, I'm glad your husband is content with the award.

Just one point though - Support Group ESA is awarded due to meeting very specific criteria, needing carers is not one of these.

I went into my local CAB to get help with my form, although the lady was very sympathetic and nice I don't think she was very well informed about the claims process. She told me that people hardly ever get home visits, low and behold I had a home assessment. 2 was ago.
It's important that whoever you go to for help actually knows what they are talking about. Just because someone works for the CAB doesn't make them an expert. It could mean that you don't actually get the right advice.

After reading your reply and talking everything through again with hubby we decided to ring for advice on not getting a point for the medication aids. I received a call back from a team assessment manager who I have to say was very nice although professional on the phone. She talked through the award with me and why he scored what he scored and after going over everything advised us to put in a reconsideration request . She has asked me to write everything down etc why he uses the aids he does etc and if possible to get a letter from GP or professional to back up why he uses these. She says we just need to confirm and give as much evidence as I can why he needs to use these aids and that he just doesn't use them for his own convenience and if I can do this they will look into having the award overlooked and changed as she said the same as you it's only 1 point and I just need to provide the correct evidence . She actually commented that the form had been very well filled out providing a lot of the correct information they need to make the decision of the award. For this I have this site and all that run it to thank as I just followed your guides and only wrote and sent the information You's advise even though after filling the booklet in I also had handwritten 40 a4 pages of further evidence along with consultant letters tests results etc(oops bet they were sick of reading it all). So I am going to provide a bit more info and maybe a letter of support from a health professional and see what happens. We know it's a risk asking for a reconsideration but I just feel if he is entitled to it which we believe he is then he will get the point which will also give him enhanced rate care. Will keep you's updated and thanks once again.
