Well I got it what a horrible process. We waited to be seen then three people on the panel judge and health professional but the Dr was something else but I got there in the end my mother was crying...but will add more later.

I've had my triberinal and have awarded me my pip however when I phoned DWP there said there is still decision to be made I should get it shouldn't I.

Hi Cyberman,

I have moved your message into the existing topic dealing with your tribunal. Please do not post your questions in other members' topics as it complicates matters unnecessarily.

Both the claimant and DWP have 1 month, from the date of the appeal decision, to request a Statement of Reasons from the Tribunal Service. This would be the first step in trying to take this to the Upper Tier Tribunal.

In practice this doesn't happen often but it sounds as if DWP are still considering their options. I'm afraid all you can do at the moment is wait :(

This can only go further if an Error of Law is found. That means that the tribunal panel made a mistake that makes the decision suspect.

What is an Error of Law?

As I say, this does happen but is certainly not common.

DWP have one month from the date of the decision in which to request a Statement of Reasons. This can take some time to arrive but you will know when it happens as you would get a copy too.

After that, there would be a further month for either party to request permission, from the Tribunal Service, to take this further.
