Good Afternoon

I recently had my PIP claim reviewed. I am relieved that I have been kept on higher rate for both daily living and mobility. I should be content but am not. Why?

1. The HCP has literally mucked about with all the descriptors and awarded points in some categories much lower than my initial claim in 2014. Others, where points were scored in 2014 now score zero.

2. The previous award was for three years reviewed after two. In the latest decision letter, the decision maker says he has given me a longer award in his notes at the end of the letter. But that's not true. The award is from 13/12/16 to 31/5/19, but they will review again on 31 May 2018. So where I got a review-free period of 2 years initially, the "longer" review-free award last from Dec 2016 to May 2018. This is less than 18 months. So not longer!

I know there is no basis to complain because I have effectively had my award extended. But I am not happy about the points issue because issues that were addressed last time, like mobility/ planning journeys, which I scored in last time after appeal, I scored nil this time. (no surprise). Here, the moving around score increased a lot to offset this.
So I feel I am storing problems for the future if I don't at least write to challenge the scores on individual descriptors - at least for the record. These scores may be picked up for my ESA review which comes up in October 2017.
Do you think I should write in just for the record so it is on their file? And should I request the medical report first?

As far as the length of the latest award goes, do you think it looks a bit odd, giving me a shorter period and stating it is longer?

I'd be really grateful for your feedback on this.

It's not uncommon for us to hear from members who are happy with their PIP award but not happy about the reasons that the award has been made.

I'm afraid the benefit system offers claimants no way to deal with these matters.

Any attempt to address the issues you raise in your post is likely to be treated as a request for a Mandatory Reconsideration, even if you avoid this, the DWP have no obligation to consider the points that you raise and I am afraid will not do so.

I do understand your concerns about the potential for future impact, but if you do not want to challenge the Decision formally, then I am afraid there is no solution to the problem.

As far as the time period of this award which is less than the previous one though stated as longer, what is your instinct?

The length of the award can only be challenged via an MR, which of course opens the whole award to review, several members have tried and all have failed, so personally I don't think it is worth trying.

I would take Gordons advice and stay well aware from an MR.
You have more of a chance of them reducing your benefits if they look at it again.

Pleased you have got your 2 high benefits, best to forget about it now and deal with the future when it comes, they could have changed the whole system by then
