In trying to understand the timeline ahead:

Request medical report
Request Mandatory Reconsideration

The above within 4 weeks, are reconsiderations acted upon quickly?

Then do i have to appeal within a time frame, or is it straight to the below?

Failing the reconsideration, then on TBS within what timeframe?

Hi Fopa,

Yes, you have one month, from the date of the decision letter, in which to submit your request for MR and have it accepted without question.

Although the claimant is under time constraints for requesting the MR, there is no time limit within which DWP must complete it. Some are done within days, others can take a few months :(

There will be 2 copies of the MR result. You will need to send one of these to the Tribunal Service, if things get that far, with a SSCS1 form within a further month.

Mandatory reconsideration requested today along with a request for the medical report. Just spoke to motability who advised that once the DWP advise motability that payments will cease, i have just under 3 weeks to return the car. This is quite worrying, as i would then have no means of leaving my house unless i can somehow buy another car in between that time frame, which i am not overly confident of. :|

I received the response to my reconsideration yesterday. Firstly i spoke to the assessor who was reviewing the mobility element of the claim, who advised me that if i could provide a letter from my doctor in regards to my mobility, then it would certainly further justify that i have should have been given the 12 points.

The doctors letter, stated that on a good day i can just about manage the 10m and a bad day, that is not achievable at all. He also mentioned that the 10m isn't possible without the strong use of prescribed opiates, he finished off by remarking that he was staggered that i had not been given the support and that he backs my case going forward.

As mentioned the response arrived yesterday, and the assessor has not felt the need to change the original award given a few poor reasons that shall be challenged, so it is off to tribunal we go.

Any links towards tribunal guides or advice would of course be greatly appreciated.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

DWP have paid pip into my bank account, which i am really concerned about, as it means the car has not been paid for and i guess motability will be on the phone shortly.

I cant even begin to describe how poorly this is impacting upon my mental health, i feel in an incredibly dark place right now and don't know if i have the energy to carry on.

Do i need to call DWP and tell them that i am taking this to tribunal?
