Hi Nick,

An appeal panel would be obliged to warn you if they were considering reducing or removing your current award. However, the Decision Maker will not do this in the MR process.

Just to clarify you can request that the appeal only look at one element of the award but there is no guarantee they will do so. At my recent appeal they did decide only to look at the mobility part of my claim but they did mention that they equally could have looked at the whole thing. Obviously at that point I could have withdrawn my appeal if I felt it was appropriate to do so.

Oh dear I am in tears with not knowing what to do.
I have scored 8 points for needing help with basic communication which is true.
I am very confident I have demonstrated in my MR letter I meet criteria to score 4 points for Mixing with people - based on factual evidence and medical history and also by giving lots of examples.
Similarly, the same with Going out to unfamiliar places - all the factual evidence of how my sensory impairment causes me difficulties with this.
But it is about them not believing me and perhaps more importantly risking my standard award. I just get the feeling that no one with a hearing impairment scores more than 8 points so even if they give me 4 for mixing with others will take 4 off me for my communication needs.....I have done all the work I am just so scared :-(

Thanks Gordon for your patience I know I am a pain. I am concentrating on proving I cannot do these tasks reliably.
I also found on a search an appeal where person lipreads and like myself been impaired since very young age - assessment only awarded her 2 points for hearing aids. Appeal gave her 8 for Communication like me 4 for Mixing with People, and the 10 for Getting around unfamiliar places as she cannot use Sat nav as cant listen to instructions and cant look at them whilst driving as need to keep eyes on road (true for me too) and also understanding bus drivers, people at train stations - announcements etc - all things I have examples of having struggled with myself so its all truthful.

Very useful links thanks Gordon. Would you know of any decisions regarding lower mobility with deafness and anxiety please? Any cases of appeal to read would be so helpful thanks
