until may 2016 in ESA Support group then had WCA and got 0 points, statements on WCA report were either untrue or deceitful insinuation. Appealed the WCA and had the appeal on 6th January 2017. Lost appeal, awarded 6 points standing/sitting. The GP was a patronizing and condescending individual, the Judge was fine, at one point she gave the GP such a look that only a woman can give. The GP ignored whatever I said and it was clear he had not read any of the medical evidence. At present I am waiting for the "statement of reasons" . I received form ESA 1 yesterday, can someone please advise what documents to send with the ESA 1?

Are you aware that you can only make a new claim for ESA if you can show that you have a new condition of you can show that your existing conditions have deteriorated since the Fit for Work Decision, such that it is accepted that you would likely receive an award of ESA. You may need to provide medical evidence in support of the change.

AS to the ESA1, if the DWP have request nothing else, then you need to provide a new Fit Note.

multi-joint arthritis has got worse, last month saw rheumatologist consultant and then occupational therapist. Got letters from both stating how arthritis has got worse. Waiting for an appointment with rheumatology physiotherapist. Seeing doc tomorrow for another sick note. sending the letters and sick note should be enough wont it ?

I'm afraid it will be up to a DM to decide, there are circumstances where a deterioration in condition may still not result in an award in which case the claim will be refused. Be prepared to explain why you now meet the criteria for the WRAG or the SG now when you did not before.

apologies for taken so much time to say thanks Gordon, but i have to use pc at library which is a bit of a pain. Regarding explaining why i now meet criteria would, apart fro m other reasons, explaining that the assessor at the wca lied ( even though she said to me she wouldnt do the physical assessment because she could see how much pain i was in!!!!!!), or mentioning that the gp at the appeal, ( if someone was being uncharitable), with his mumbling (slurring?) had a slight resemblance to someone who may have had a liquid lunch. I am not joking!!!.
Thanks again, an invaluable site.
