Hi, I received my MR response back they did not change their decision. I am now starting my appeal. I would appreciate any help or advice to do this, but just a couple of questions I need to check on.
Should I put a brief explanation of why I disagree with their decision on the relevant descriptors? is it OK to put down the points I think I should have got working through all the ones which apply to me?
Is there any guidance as to how much info you send with your appeal? There are so many inadequacies and I don't think putting them all down would be a good idea but wondered if I should mention it in my grounds for appeal? I think I need to concentrate on how all my problems affect me day to day. Thank You!

Hi Cazza,

I am sorry, but not surprised, that the MR did not go in your favour :(

You do not need to give much information when you request your appeal. Don't forget to send in the SSCS1 form and copy of the MR decision!

Once the appeal has been accepted the Tribunal Service will notify DWP. DWP will then prepare their submission, explaining why they made their decision and disagree with your appeal. You will be sent a copy of this, along with all the other paperwork DWP have in relation to this claim.

We recommend that you start thinking about your own submission now but don't actually write it until you have seen what DWP have to say. This gives you the chance to rebut DWP's arguments.

Don't forget that you will only gain the award you think is correct by showing how/why you meet the specific descriptors. Don't spend too long arguing against every word of the assessor's report, the Tribunal Panel will be much more interested in hearing from you about how your conditions affect your ability to perform the activities associated with the descriptors. They will probably not pay much attention to the report.

Go back to the guide for the benefit in question and make sure you understand exactly what the descriptors mean. Some of them have more than 1 element and you will have to satisfy them all in order to score the points.

May I suggest that you bookmark/favourite this on your web browser now so that you can find it in future? You probably remember that we ask members to keep everything relating to the same claim in one topic rather than starting a new topic for each question :)

Thank you Mrs Hurtyback. I have just printed the SSCS1 form ready to fill in and my MR decision is safely with it. It says I have to put the reason for my appeal so not sure what to put now? I was going to put all my info on this form, I didn't realise you could add to it once it had all been posted, I think I am a little worried they won't accept my appeal on brief information.

Will the submission be acceptable once I have all the paper work which the DWP will send to the Tribuneral and them to me? Sorry, just feeling a little confused at the moment.

I understand the importance of showing how I meet the specific descriptors and I have already started making some notes and I have the guide out now to go back through it and check I have all the relevant information for the descriptors.

I always come to my profile page to post when I find it lol, I just changed the subject line this time, I wont change it again.

I appreciate your response.

I suggest you briefly make your main points when you send in the appeal request.

You will have until 7 days before the appeal date to send in your full submission. That is why we suggest waiting until you have seen what DWP have to say.

BTW, you will find your previous messages easily if you click on your username, in blue, when you are logged into the forum.

Great thank you again. I will do that asap and get it posted, Then go back and check all of the descriptors and both reports. Thanks for the advice finding my messages much easier :)
