Hi

My son received his PIP Review form and we completed and sent it off giving as much information as possible regarding any changes.

He received a letter from Capita on 13th January saying "you recently applied for Personal Independant Payment" and then goes on to explain what happens next and what to expect.

Does anyone know if this is normal or have they made a mistake in assuming its a new claim rather than a review?

Do you think we should call them to say this is not a new claim?

My son received a letter this morning asking him to attend an assessment at 8.10am :( at the end of this month.
This is for a PIP review.
He is going to try and change the appointment as he cannot possibly get to the centre, which is over an hour away on a bus, at that time of the morning.
His medication prevents him from being functional until at least the afternoon.
My question is should we ask for a copy of his previous medical assessment for PIP?
He is in the process of appealing his ESA and we have a copy of his ESA assessments from the DWP bundle, but I have read on the guides that the DWP uses ESA health assessment form ESA85 when looking at PIP.

Hi elie,

Your son should have his diary at hand when he phones to change the assessment appointment so that the next one is at a convenient time. The claimant is allowed to change the appointment just once without penalty.

It is up to you, you can certainly request a copy of the previous PIP paperwork if you think it might be helpful. I expect it will be stored off-site now, so you should submit a Subject Access Request (SAR).

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your PIP.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

Sending Documents to the DWP.

Hi

Thank you for your reply.

I have changed the date and time of the appointment but it is 3 days earlier and we won't have time to request, and probably receive, the previous health assessment.

This is so worrying not only are we fighting for his ESA at the tribunal but having to deal with this as well at the same time its just overwelming.
